Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Jhanko mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms form a legally binding agreement between you and Jhanko ("we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

To use Jhanko, you must:

Be at least 18 years of age, or have the consent of a parent or legal guardian if between 13 and 18.
Be a resident of India or accessing the App from a jurisdiction where its use is lawful.
Provide accurate, complete, and current information during registration.
Have the legal capacity to enter into a binding agreement.

We reserve the right to refuse service or terminate accounts that do not meet these requirements.

3. About Jhanko

Jhanko is India's first Hyperlocal Visual Discovery Platform. Our mission is to help users explore and support their local neighbourhood economy, while enabling local sellers and service providers to compete digitally at zero commissions.

The App enables the following roles:

Customers — Browse, search, follow, and review local businesses and service providers near you.
Business Owners — List your business, showcase products, manage your profile, and connect with local customers.
Service Providers — List your services across categories including home repair, beauty & grooming, transport & mobility, education, professional services, and more. Build a local customer base and receive ratings and reviews.

        Jhanko is a discovery and connection platform only. We do not facilitate, process, or guarantee any transaction, payment, or service delivery between users.
      

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

Provide truthful and accurate registration information.
Not share your account credentials with any other person.
Notify us immediately at jhanko.contact@gmail.com if you suspect unauthorised access to your account.
Not create multiple accounts to circumvent restrictions or bans.

5. Rules for Business Owners and Service Providers

If you register as a business owner or service provider on Jhanko, you additionally agree to:

Only list businesses or services that you are legally authorised to operate or offer.
Provide accurate and up-to-date information — including business name, location, pricing, products, and services.
Not post fake reviews, manipulate ratings, or engage in any deceptive practices.
Not use Jhanko to promote illegal products, services, or activities of any kind.
Comply with all applicable Indian laws and regulations relating to your business or profession.
Ensure that all media (images, videos) you upload is either owned by you or properly licensed for use.

6. Prohibited Conduct

All users agree not to:

Post false, misleading, or defamatory content about any person or business.
Harass, threaten, or abuse other users on the platform.
Attempt to gain unauthorised access to Jhanko's systems or other users' accounts.
Scrape, crawl, or extract data from the App without prior written permission from Jhanko.
Use the App for spam, phishing, or any unlawful purpose.
Upload malware, viruses, or any harmful code.
Impersonate any person, business, or entity.
Engage in any activity that disrupts or interferes with the functioning of the App.

7. Account Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate your account at our sole discretion, with or without prior notice, if we determine that you have violated these Terms or engaged in conduct harmful to other users, third parties, or Jhanko.

Grounds for suspension or termination include but are not limited to:

Fraudulent or misleading listings.
Fake or manipulated reviews.
Abusive or threatening behaviour toward other users.
Violation of applicable Indian laws.
Providing false registration information.

You may delete your own account at any time from within the App under Account Settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

8. Intellectual Property

All content, trademarks, logos, and technology within the Jhanko App are owned by or licensed to Jhanko and are protected under applicable Indian intellectual property laws.

By uploading content (images, text, videos) to the App, you grant Jhanko a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content solely for the purpose of operating and improving the App.

You retain full ownership of content you upload. You represent and warrant that you have the right to upload it and that it does not infringe any third party's intellectual property or other rights.

9. Limitation of Liability

Jhanko is a discovery and connection platform. We are not a party to any transaction, arrangement, or agreement between users. We do not verify, endorse, or guarantee the quality, safety, legality, or accuracy of any listing, product, or service offered by any user on the platform.

To the maximum extent permitted by applicable law, Jhanko shall not be liable for:

Any loss or damage arising from transactions or interactions between users.
Inaccurate, incomplete, or misleading information posted by users.
Any indirect, incidental, special, consequential, or punitive damages.
Temporary interruption or unavailability of the App.

        Your use of the App and any interaction with other users is entirely at your own risk.
      

10. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the App will be uninterrupted, completely error-free, or free from viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.

11. Third-Party Services

The App integrates third-party services including Firebase (Google) for authentication and push notifications. Your use of the App is also subject to the applicable terms and privacy policies of these third-party providers. Jhanko is not responsible for the data practices or conduct of any third-party service.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, including the Digital Personal Data Protection Act, 2023, and other applicable Indian legislation.

Any dispute arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts located in India.
